1. Preface and Definition’s

   “Website” refers to www.glammakeover.com (referred to herein as “we”, “us”, or “our”).

         “User” refers to any individual accessing or using the Website.

  “Service(s)” refers to the home beauty salon services provided by www.glammakeover.com  

By using the Website, you acknowledge that you have read, understood, and agree to be          bound by these Terms and Conditions.

2. Electronic Records(e-records)

2.1 According to the provisions of the Information Technology Act, 2000, the present document shall be deemed as well as constituted to be electronic record (e-records). The rules are applicable to amended provisions as well as electronic records but not limited to legislations stipulated in several electronic records related statues. This electronic record does not require any digital or physical signatures because it is generated through a computer system.

2.2 According to the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011, this document is being published on www.glammakeover.com  

3. Introduction

• We thank you for registering with our website. The following terms and conditions govern all use of the website and all content, services, and products available at or through the website. The Website is owned and operated by Urbanica India or Glam Makeover as its brand. The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Glam Makeover Privacy Policy) and procedures that may be published from time to time on this Site by glammakeover.com(collectively, the Agreement).
• By using the Website, you represent that you are at least 18 years of age and are legally capable of entering into a binding contract. If you are accessing the Website on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms and Conditions.
• The website and services usage provided by Glam Makeover are available only to those persons who adhere to a legal binding contract under Indian Contract Act, 1872. In case you are “incompetent to contract” under Indian Contract Act, 1872 including insolvents, minors, un-discharged, etc. then you are not eligible to place orders telephonically or use the Website. If you are under 18 years of age, then you are not allowed to register as a Website member and shall not transact or use any Services. However, it is clarified that during placing any order telephonically or registration as a website member, Glam Makeover shall only rely on the information given by you. In case we find that the information provided by you is incorrect then you have to compensate Glam Makeover as brand or Urbanica India as legal entity and hold Glam Makeover safety against any third party criminal or civil claim.

4. Registration and Account Security

4.1 Users must register an account to access certain features of the website. Users agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Users are solely responsible for maintaining the confidentiality of their account and password and for restricting access to their computers, and agree to accept responsibility for all activities that occur under their account or password.

4.2 Each time you log in, a unique OTP will be generated for you. It’s your responsibility to keep this OTP and your account details confidential, and you’re fully liable for all actions taken under your account. You agree to (a) promptly inform Glam Makeover of any unauthorized use of your account or any security breaches, and (b) ensure that you log out of your account after each session. Glam Makeover cannot and will not be held responsible for any losses or damages resulting from your failure to adhere to this provision.

5. User Conduct

Users agree not to use the website to i. Violate any applicable laws or regulations.ii. Infringe on the rights of others.iii. Submit false or misleading information.iii. Engage in any fraudulent activity.iv. Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive   nature. Interfere with or disrupt the website or servers or networks connected to the website.

6. Our Services & Usage

• Glam Makeover acts as a platform connecting users with home beauty salon service providers. At times Service Providers could be independent contractors and are not employees, agents, partners, or affiliates of glammakeover.com. Glam Makeover may also provide beauty services directly through its employee or individuals to perform such services.
• You understand and agree that by registering with Glam Makeover, You will be able to opt for wellness, grooming and beauty services (Service) within the premise and comforts of your home.
• The entire appointments are booked through telephonically and online which are directly subject to the availability of service slots and beauticians. Also, your appointment will only be finalized and accepted when you choose to take minimum 1+ hour of service. Any services chosen by you that does not sum up for at least 1+ hour will not be entertained by our beauticians.
• Glam Makeover reserves the rights to cancel any appointment that seems suspicious or may concern to safety of its beauticians or any other such reasons which will be clearly notified to customers. All refund will be liable to refund policy stated on our website.
• In case our beauticians fail to reach on time, we will inform you through message or call about delay. In all circumstances our maximum liability shall be limited to appointment rescheduling in the next available slot.
• On the basis of skills and training of beauticians, the rates are applied. All the rates and packages will be decided by Glam Makeover and non-negotiable apart from any such offer or discount that may route through Glam Makeover website.

7. User’s Account for using Glam Makeover Services

7.1 By selecting our home service, you recognize and agree that although our main objective is to consistently deliver exceptional service, there are specific responsibilities that fall on you as the customer.

1. You are obligated to settle the complete payment for all services rendered, as outlined in the  invoice provided to you following the service, encompassing service fees, product expenses, and applicable taxes.
2. It is your responsibility to ensure that no devices or products, whether technical or otherwise, are misused, soiled, or damaged by the technicians.
3. You must refrain from requesting the technician to perform or refrain from any action that contradicts the established procedures followed by our technicians during service delivery. Our technicians reserve the right to decline service requests from customers for any reason. If you have any grievances, we encourage you to contact our customer care team for support and resolution.
4. You and any other occupants of your premises are expected to treat our technicians with respect and refrain from harassment, abusive language, physical violence, or any unlawful behaviour. If you are dissatisfied with the service, you have the option to request the technicians to leave and provide feedback or lodge a complaint via our website or app. We will endeavour to provide specialized assistance within 24 hours of receiving your message.

7.2 Though we strive to ensure that every customer enjoys a seamless and comfortable experience. However, should a customer suffer any loss or damage directly resulting from a technician’s error or negligence while providing services, Glam Makeover’s liability is strictly limited to a maximum of Rs 11,000/- (Eleven Thousand Rupees only) subject to terms and conditions, pending a thorough investigation and inspection by Glam Makeover. We do not accept liability for incidental, punitive, or consequential damages arising from the use of our services

7.3 We encourage our customers to assume full responsibility for their belongings. If any items are found missing after availing our services, we recommend informing us within 24 hours from the time the service was rendered. While we will make every effort to locate the missing items, we cannot be held liable for any damage or loss incurred in this regard

7.4 If you notice any suspicious activity or have any complaints about our beauticians or services, please notify us in writing within 24 hours of using the service. We, Glam Makeover hold no responsibility or will not be liable for the actions of beauticians.

8. Pricing & Payment Terms

 8.1 For the services you request through the Platform, you’ll need to pay the Service Professionals the amount specified at the time of booking, along with (a) any additional services you request, (b) any out-of-pocket expenses incurred by the Service Professional, and (c) expenses related to the purchase of goods needed for the service. Besides the charges for the Service Professionals, Glam Makeover may charge you a convenience fee for managing the booking and transferring payments to them you understand that the final bill may include extra charges, such as a safety fee, warranty fee, insurance fee, or Service Professional welfare fee and all Charges and Fees are inclusive of applicable taxes.

8.2 The prices of products and services are outlined on our Website/WhatsApp/offline booking and are considered part of these Terms. All prices are stated in Indian rupees and are subject to modification at the discretion of Glam Makeover, with no prior notice to the Customer.

8.3 Glam Makeover reserves the right to reasonably amend the Charges and Fees at any time at its sole discretion. However such modification will not be applicable for prior or advance booking unless its publish on website and services availed after that.

8.4 Cancellation – You may elect to cancel your request for beauty services opted through website at any time prior to 1 hour or such Service Professional’s arrival, in which case you may be charged a cancellation fee i. If the beautician has left for your service flat Rs 100 cancellation charges. ii. If beautician has arrived at your place flat Rs 200 will be deducted as part of cancellation. Glam Makeover reserves the right to charge you, or otherwise deduct applicable taxes in respect of such cancellation fee. Waiving of any cancellation fee /applicable taxes will be at sole rights and discretion of Glam Makeover.

8.5 If you have rescheduled any service booking prior to 1 hr then no cancellation charge will apply. Also, in case of unforeseen incident (accident etc.) and no show of beautician you are entitle to get full refund.

9. Intellectual Property

All content included on this website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, hyperlinks, trade secret,trademarks ,goodwill and software, is the property of www.glammakeover.com  or its content suppliers and protected by Indian and international copyright laws. Any use must be approved or authorized in writing by Glam Makeover prior to such uses.

10. Third Party Services and Use

 10.1 Glam Makeover might feature services, content, documents, and information provided by third parties (“Third Party Services”), along with links to such services. You recognize and accept that Third Party Services are entirely the responsibility of the third party that offers them, and using such services is solely at your own risk.

10.2 We do not provide any assurances and disclaim all responsibilities and liabilities related to Third Party Services, including their accuracy or comprehensiveness. If you use a Third Party Service, you must comply with the terms, conditions, and privacy policies set forth by the third-party providers. Additionally, all intellectual property rights associated with Third Party Services belong to their respective third-party owners.

11. 11. Limitation of Liability

To the maximum extent permitted by applicable law, glammakeover.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the website; (b) any conduct or content of any third party on the website.

12. Termination

12.1 We (Glam Makeover) believe, at our sole and absolute discretion, that you have violated, abused, or unethically manipulated any of these Terms, we reserve the right to remove you from our platform and/or terminate your access to the Website and its services.

12.2 If You or Glam makeover terminates Your use of the Website or any Service, We may delete any content or other materials relating to Your use of the Service and we will have no liability to You or any third party.

12.3 You are liable to pay for all products and services which you have ordered till the time of your termination.

13. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of India. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts in Gujarat.

14. Changes to Terms

Glam Makeover reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes.
